Terms of Use
The following terms of use govern your use of the web-based services provided by IdeaJets, Inc. on www.ideajets.com. These services include, without limitation, any and all web-based products that IdeaJets offers.
BY CLICKING THROUGH THE "AGREE" BUTTON AND COMPLETING THE REGISTRATION PROCESS, YOU ARE MANIFESTING ASSENT TO THESE TERMS AND CONDITIONS AND YOU AGREE TO BE BOUND BY THEM.
1. ACCURATE REGISTRAITON INFORMATION. You represent that you are providing IdeaJets with truthful and accurate registration information. You will update any registration information as is necessary to keep it truthful and accurate. All services are available only to adults 18 years of age and older. You represent and warrant that you are at least 18 years of age and legally able to enter into contracts.
2. MEMBER NAME AND PASSWORD. In order to register for IdeaJets services, you must assent to these Terms of Use. When you accept these Terms of Use, you will have to create a Member Name. You may not use a member name that is used by someone else and your member name cannot be vulgar or used in any way that violates the Terms of Use. You are responsible for all activity on your account. You will select a password for your account. You agree not to reveal your password to other users and you agree to indemnify and hold harmless IdeaJets for any improper or illegal use of your account. This includes illegal or improper use by someone to whom you have given permission to use your account.
3. MODIFICATION OF THE TERMS OF USE. IdeaJets may at any time modify the Terms of Use. It is your responsibility to review from time to time and stay familiar with these Terms of Use. Your continuing use of the IdeaJets web services constitutes your acceptance of the Terms of Use as modified.
4. MODIFICATION OF THE SERVICE. IdeaJets reserves the right, in its sole discretion and at any time, to modify or discontinue any or all of the services; limit, terminate or suspend your account; change prices and modify storage capacity; change the amount of time that listings or other data are stored.
5. USE OF SERVICES. You are solely responsible for all the data and messages that you create and acknowledge that IdeaJets acts as a passive conduit for the transmission of such data. You may not use IdeaJets services to conduct any business or activity, or solicit the performance of any activity, which is prohibited by or would violate any applicable law, rule, regulation or legal obligation. Such prohibited activities include, without limitation, the use of the website to publish, post, distribute or disseminate any:
Sexually explicit/vulgar/obscene content or language.
Racially or ethnically offensive content.
Content or messaging that exploits a minor (any person under the age of 18) including, without limitation, requesting personal or other information from a minor (any person under the age of 18), including, without limitation, any of the following: full name, home address, social security number, email address, telephone number, picture, or the name of their school.
Content that infringes anyone's intellectual property rights, including but not limited to any copyright, trademark, rights of publicity, rights of privacy, or other proprietary rights.
Material that defames, abuses or threatens physical harm to others or oneself.
Content in violation of law, regulations or other legal proceedings including, without limitation, material that solicits or promotes goods, services or activities that are prohibited by law, regulation or other legal proceedings.
Content depicting gratuitous violence.
Soliciting a user's password(s) or other personal information.
Multi-level marketing or pyramid schemes
Raffles or contests
Advertising of:
- Lottery
- Ammunition
- Firearms
- Tobacco
- Alcohol
Adult services, such as phone sex or escort services.
Other content that IdeaJets deems inappropriate.
6. VIOLATIONS. IdeaJets determines in its sole discretion whether there has been a violation of these Terms of Use and the remedies it may take. Violations of these Terms of Use may result in actions ranging from a warning, to suspension of access to this feature, to appropriate legal action.
7. MEMBER PRIVACY. IdeaJets does not disclose data submitted by its members except to comply with valid legal process such as a search warrant, subpoena or court order, to protect the company's rights and property or during emergencies when IdeaJets believes physical safety is at risk.
8. DISCLAIMERS/LIMITATION OF LIABILITY. You understand that NEITHER IDEAJETS NOR ANY OF ITS PARTNERS, AGENTS, AFFILIATES, SUPPLIERS OR CONTENT PROVIDERS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, LOST PROFITS, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO ANY USE OF THE PRODUCTS.
IDEAJETS and its members do their best to provide accurate information in Listings
and on the services of the Website; however against all our efforts their can be some typographical and technical errors on it. IDEAJETS cannot be held liable for any losses or damages resulting from the inaccuracy of any information on the Website.
9. LISTINGS AGREMENT. IDEAJETS does not allow its members to submit information that infringes on any copyright, property, trademark or any other applicable right. IdeaJets members are solely responsible for the information that they submit. You agree that you own all proprietary rights regarding the information containing in your listings and that the IDEAJETS cannot be held responsible for the misuse or abuse of any Listing.
10. INDEMNIFICATION. You agree to indemnify IdeaJets and its partners, agents, affiliates, suppliers and content providers against all claims, liability, damages, costs and expenses, including but not limited to reasonable attorneys' fees, arising out of or relating to your use of the IdeaJets services.
11. ENTIRE AGREEMENT. These Terms of Use constitute the entire agreement between IdeaJets and you with respect to the subject matter thereof.
12. TERMINATION. Either you or IdeaJets may terminate your at any time for any reason. You understand and agree that the cancellation of your account is your sole right and remedy with respect to any dispute with IdeaJets.
